Once you have found the perfect employee (or at least one that satisfies your desperation standards), then you are ready to make the job offer.

You could just call him (or her) over the phone and say “We want you, we have to have you, we promise you the moon if only you will only grace us with your presence.”  Or, you could try and protect yourself from misunderstanding and those nasty lawyers later on by sending a formal job offer letter.

Here is an example of such a letter:

                        Your compensation will be a salary at the annual rate of $__________, payable in [weekly, biweekly, monthly] installments; __________ weeks of paid vacation for each full year of employment completed; and participation in the health and other benefit plans of the Company according to their terms and as may be amended or terminated from time to time.

 

                        Our employment relationship will be terminable at will, which means that either you or the Company may terminate your employment at any time and for any reason or for no reason.

 

                        In the event a dispute does arise, this letter, including the validity, interpretation, construction and performance of this letter, shall be governed by and construed in accordance with the substantive laws of the State of [California or other State].  Jurisdiction for resolution of any disputes shall be solely in [State].

The Americans with Disabilities Act

 THE AMERICANS WITH DISABILITIES ACT

 The Americans with Disabilities Act of 1990 (ADA) covers employment, public accommodations, transportation, and telecommunications; and it affects the employment, training, promotion, compensation, and termination policies of every employer having 15 or more employees. It also affects businesses that provide goods and services to the public.

The ADA borrows the definition of disability from the Rehabilitation Act of 1973, by defining it as (1) "a physical or mental impairment that substantially limits one or more of the major life activities," (2) "a record of such impairment," or (3) "being regarded as having such an impairment."
